These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Pavel Traskou, an individual acting as the sole provider and operator of the Sanaq service (“Sanaq”, “Service”, “Provider”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms.
1. Introduction and Acceptance
Sanaq is a retail management software platform consisting of:
Owner Application (“Owner App”) — used for store configuration, analytics, pricing, loyalty programs, employees, and subscription management.
Point-of-Sale Application (“POS App”) — used for cashier operations including sales, returns, shifts, discounts, and loyalty redemption.
If you do not agree with these Terms, you must not use the Service.
2. Definitions
Account — a registered user profile created using login credentials.
Subscription — paid access to the Service following the Trial Period.
Trial Period — a limited 7-day free access period.
Store — a retail unit configured within the Owner App.
POS — a device running the POS App.
Customer Data — information about customers entered by Users.
User Content — product data, inventory, pricing, and other operational data uploaded by Users.
3. Eligibility
You may use the Service only if:
You are at least 18 years old;
You have legal capacity to enter into binding agreements;
If acting on behalf of a business, you are authorized to bind that entity.
The Service is available globally. You are responsible for compliance with local laws.
4. Account Registration and Security
Registration requires basic login credentials. No business verification or KYC is required.
You are responsible for:
Maintaining confidentiality of account credentials;
All activities conducted under your Account;
Ensuring employees use the Service appropriately.
We are not responsible for unauthorized access resulting from failure to secure credentials.
5. Description of the Service
Sanaq provides tools for:
Store and company configuration
POS operations
Sales and return processing
Marketing campaigns and loyalty programs
Cash control and shift tracking
Retail analytics and reporting
Subscription and billing management
We may modify, update, or discontinue features at any time.
6. Trial and Subscription
A 7-day Trial Period may be provided to new users.
After the Trial Period:
An active paid Subscription is required to continue using the Service.
There is no permanent free plan.
Access may be limited or suspended if payment is not received.
Subscription limits, quotas, and pricing are displayed inside the Service or on the website.
Subscriptions renew automatically unless cancelled before the end of the current billing period.
7. Billing, Payments, and Merchant of Record
Payments are processed by Paddle.com Market Limited, who acts as Merchant of Record for all transactions.
Paddle is responsible for:
Billing and payment processing;
VAT and sales tax handling where applicable;
Issuing invoices and payment receipts.
By purchasing a Subscription, you agree that:
Billing terms may be governed by Paddle’s checkout terms;
Your payment information is processed by Paddle, not by Sanaq;
Subscription charges renew automatically until cancelled.

8. User Responsibilities
You are solely responsible for:
Accuracy of product pricing and tax configuration;
Compliance with tax, accounting, and retail regulations;
Lawful collection and use of Customer Data;
Cash register compliance in your jurisdiction;
Actions performed by employees using your Account.
Sanaq does not guarantee legal compliance of your retail operations.
9. Loyalty Programs, Discounts, and Promotions
The Service allows configuration of:
Marketing campaigns;
Manual discounts;
Loyalty bonus systems;
Store and employee-based restrictions.
All calculations are executed automatically based on User-defined settings. You are responsible for proper configuration.
10. Data Processing and Privacy
Users act as data controllers for Customer Data entered into the Service.
Sanaq acts as a data processor providing technical infrastructure.
You represent that:
You have lawful grounds to process Customer Data;
Required customer consents are obtained where applicable;
Your data practices comply with relevant data protection laws.
Platform-level data practices are governed by our Privacy Policy.
11. Intellectual Property
All rights, title, and interest in Sanaq, including software, UI, branding, and analytics systems, remain the exclusive property of the Provider.
You receive a limited, non-exclusive, non-transferable license to use the Service during an active Subscription.
You may not:
Reverse engineer or decompile the Service;
Copy or redistribute software components;
Create derivative works;
Use the Service to build a competing product.
12. Availability and Technical Limitations
The Service may include:
Offline caching with limited functionality;
Periodic synchronization;
Scheduled maintenance downtime;
API and infrastructure limitations.
We do not guarantee uninterrupted availability.
13. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
To the fullest extent permitted by law, we disclaim all warranties, including:
Merchantability;
Fitness for a particular purpose;
Non-infringement;
Accuracy of analytics;
Continuous uptime.
14. Limitation of Liability
To the maximum extent permitted by applicable law, the Provider shall not be responsible for:
Lost profits or revenue;
Business interruption;
Data loss;
Tax penalties or regulatory fines;
Cash discrepancies or employee misuse.
Total liability arising from the Service shall not exceed the total amount paid by you for the Service during the preceding three (3) months.
15. Suspension and Termination
We may suspend or terminate your Account if:
Payment is overdue;
You violate these Terms;
You engage in unlawful activities;
You misuse the Service.
You may cancel your Subscription at any time through account settings.
Upon termination:
Access to the Service may be revoked;
Data retention periods may apply;
Refunds are subject to the Refund Policy.
16. Governing Law and Dispute Resolution
These Terms shall be governed by the applicable laws of the Provider’s country of residence, unless mandatory local law requires otherwise.
The parties agree to attempt good-faith negotiations before initiating formal legal proceedings.
17. Changes to the Service or Terms
We may update these Terms periodically.
Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
